User Content

1. Generally User Content. Certain features of LINYUM may allow users to upload content, including but not limited to messages, reviews, photos, videos, images, folders, data, text, and other types of works ("User Content"), and to post User Content on our website, social media channels, emails, etc. By submitting User Content to the Service, you retain all copyright and other proprietary rights you may have in the User Content you submit, post, or display on or through the Service.
2. Grant of Limited License to Company. By providing User Content to LINYUM or by posting any User Content to any social media platform with a Company-branded hashtag or by tagging the Company, you hereby grant the Company a worldwide, non-exclusive, irrevocable, transferable, royalty-free, fully paid-up right and license to use, host, store, transfer, display, perform, reproduce, format for display, modify, and distribute (including sublicensing) your User Content in whole or in part in any media formats and through any media channels now known or hereafter developed.
3. Grant of Limited License to Other Users. By providing User Content to LINYUM, you grant other users a non-exclusive license to access and use such User Content as permitted by the functionality of the Terms and Service.
4. User Content Representations and Warranties. The Company disclaims any and all liability in connection with User Content. You are solely responsible for your User Content and the consequences of providing User Content. By providing User Content to LINYUM, you represent, warrant, and covenant that:

You are the creator and owner of the User Content or have the necessary licenses, rights, consents, and permissions to grant the Company and users of the Service the licenses to use your User Content as necessary to exercise the licenses granted by you in this section and in the manner contemplated by the Service and these Terms; Your User Content and the use of your User Content as contemplated by these Terms: (i) will not infringe, misappropriate, or violate any third-party rights, including any copyright, trademark, patent, trade secret, moral rights, privacy rights, publicity rights, or other intellectual property or proprietary rights; (ii) will not slander, defame, libel, or invade the right of privacy, publicity, or other property rights of any other person; or (iii) will not violate any law or regulation or otherwise cause the Company to incur liability; and Your User Content cannot be reasonably considered to be harmful, abusive, inappropriate, pornographic, harassing, threatening, defamatory, hateful, or otherwise offensive by a reasonable person.

5. User Content Disclaimer. We have no obligation to edit or control User Content posted or submitted by you or other users, and we will not be in any way responsible or liable for User Content. However, the Company reserves the right, at any time and without prior notice, to review, remove, edit, or block any User Content that violates these Terms or is otherwise objectionable, in our sole discretion. You understand that you may be exposed to User Content from various sources while using the Service, and you acknowledge and agree that User Content may be inaccurate, offensive, indecent, or objectionable. You hereby waive any and all legal or equitable rights or remedies you have or may have against the Company with respect to any claims arising out of or related to any User Content. If a claim is made by a user or content owner that the User Content does not comply with these Terms, we may investigate the claim and may, in our sole discretion and without notice, decide whether to remove such User Content. To be clear, the Company does not permit activities on the Service that infringe copyright.
6. Content Monitoring. We do not monitor or control: (a) User Content; (b) any content made available to third parties; or (c) the use of the Service by users. You acknowledge and agree that the Company reserves the right to monitor all information transmitted or received through the Service for operational and other purposes from time to time. If the Company chooses to monitor the content at any time, the Company assumes no responsibility or liability for any loss or damage resulting from the content or the use of the content. Information may be reviewed, recorded, copied, and used during monitoring in accordance with our Privacy Policy.
